How to Challenge Your Initial Rent in Switzerland

The 30-Day Deadline

You have exactly 30 days after receiving the keys to challenge your initial rent. The deadline starts the day after the handover.

Important: In cantons with a form obligation (ZH, ZG, SZ, NW, OW, LU, FR), the deadline only starts once you receive the official form with the previous rent.

When Can You Challenge?

A challenge is possible if at least one of these conditions is met:

  • Personal hardship: You had to rent the apartment because you were under pressure (e.g., job relocation, family reunification).
  • Housing shortage: Your region has a housing shortage (applies to most German-speaking Swiss cities).
  • Increase over 10%: The rent was increased by more than 10% compared to the previous tenant.

The Form Obligation

In the cantons of Zurich, Zug, Schwyz, Nid- and Obwalden, Lucerne, and Fribourg, the landlord must provide an official form at the start of the tenancy that discloses the previous rent.

Did not receive the form? Then the rent is not legally agreed upon. You can challenge it at any time — the 30-day deadline does not apply.

If the form is incomplete or incorrect (e.g., missing previous rent), the same applies.

The Challenge Process

  1. Get advice: Contact the Mieterverband (Swiss Tenants Association) in your region for an initial assessment.
  2. File a request: Submit a written request to the Schlichtungsbehörde (conciliation authority) in your district.
  3. Conciliation hearing: Both parties are invited to a hearing.
  4. Agreement or court: The goal is an agreement. If that fails, you receive authorization to proceed to court.

Chances of Success

Your chances depend on several factors:

  • The amount of rent increase compared to the previous tenant
  • Comparison with local and neighborhood rent levels
  • Whether renovations were done that justify an increase
  • Changes in the reference interest rate
