The 5 Essential Rules

  1. Written on paper — Email, SMS, or WhatsApp are not valid.
  2. All tenants must sign — For married couples, both partners.
  3. Send via registered mail — This gives you proof of delivery.
  4. Receipt date counts — Not the postmark date.
  5. Use the correct termination date — Check your lease for allowed dates.

Notice Period: 3 Months

The legal notice period for apartments in Switzerland is 3 months. Your termination must be effective on a customary or contractually agreed date.

Example: To move out by September 30, your termination must be received by the landlord no later than June 30.

Termination of Lease Agreement for the Apartment at [Street, Postal Code City]

Dear Sir or Madam,

I/We hereby give notice to terminate the lease agreement for the above-mentioned apartment, effective [termination date, e.g., September 30, 2025].

Please confirm receipt of this termination in writing and confirm the end date of the tenancy.

Kind regards,

[Signature of all tenants]
[Names in print]

Moving Out Early with a Replacement Tenant

If you want to move out before the notice period ends, you can propose a replacement tenant (Nachmieter). The landlord must accept if:

  • The replacement tenant is solvent (clean Betreibungsauskunft)
  • They are willing to take over the lease under the same conditions
  • They are acceptable to the landlord

Recommend proposing at least two or three qualified candidates.

Common Mistakes to Avoid

  • Sending termination via email instead of paper
  • Only one partner signing (for married couples)
  • Sending too late (missing the receipt deadline)
  • Wrong termination date (not customary)
  • Not using registered mail (no proof of delivery)

Frequently Asked Questions

What is the notice period for apartments in Switzerland?

The legal notice period is 3 months. Your termination must be effective on a customary or contractually agreed date (often end of March, June, or September).

Can I terminate my lease via email?

No. Termination via email, SMS, or WhatsApp is not legally valid. The notice must be in writing on paper and signed by all tenants on the lease.

Does my partner need to sign too?

Yes. For married couples and registered partnerships, both partners must sign — even if only one person is named on the lease.

Can I move out earlier with a replacement tenant?

Yes. If you find a solvent, suitable replacement tenant willing to take over the lease under the same conditions, you can be released from the contract early.

When does my notice need to arrive?

The date of receipt matters, not the postmark date. Plan at least 5 business days in advance and send via registered mail (Einschreiben).
